US mother accused of killing three children appears in court as defence seeks dismissal

Lindsay Clancy, the 36‑year‑old American woman charged with murdering her three children, appeared in court on Tuesday as her lawyer asked the judge to dismiss the case.

Clancy’s defence, led by Kevin Reddington, argued that the prosecution had not met its burden of proof and invoked Massachusetts Rule 25, which allows a not‑guilty finding if the state’s case is ineffective. The lawyer also introduced a new argument that there is insufficient evidence to prove Clancy killed the children, shifting from the earlier focus on severe postpartum psychosis.

Prosecutors, represented by District Attorney Timothy Cruz, maintained that the killings were intentional and that the evidence showed Clancy was mentally competent at the time. They have not yet decided whether to seek a retrial.

The request to dismiss the case will be considered at a hearing scheduled for 2 November, when Judge William Sullivan also expects both sides to discuss possible trial dates. Reddington indicated that a new trial could not commence before June.

The case previously ended in a mistrial on 4 September after a jury dead‑lock, with a single juror refusing to reach a verdict.
