Minister for Justice Jim O’Callaghan has come under scrutiny after allegations that a protected Garda whistleblower disclosure was mishandled.

Helen McEntee told the Dáil on Thursday that she did not disclose the identity of the whistleblower when she forwarded his protected disclosure to An Garda Síochána in 2023. The whistleblower, Detective Superintendent Brian O’Reilly, disputes this, saying the Garda commissioner was unaware he had approached the minister.

Fine Gael TD Peadar Toibin has accused the minister of breaking the law by sending the disclosure to An Garda Síochána, and McEntee has refused to specify which law she was acting under.

Later that day, the family of Garda Colm Horkan, murdered on 17 June 2020, called for a public inquiry into the handling of whistleblowers and the alleged faulty holster that may have contributed to his death.

In the Seanad, former minister Michael McDowell named another whistleblower, Luke Rochford, who is currently on trial, claiming he is the victim of a “major vicious campaign” and false accusations of possessing semtex.

McDowell also noted a proposal to delay Rochford’s trial by a year due to publicity from an RTÉ programme, highlighting concerns that the criminal justice system may be used to silence Garda whistleblowers.
